Data Recovery Agreement

DATA RECOVERY IS NOT GUARANTEED. There will be no charge unless Ready For Knowledge, Inc., recovers the data indicated by CLIENT to be of importance. If only a portion of the important data is recovered, Ready For Knowledge, Inc. shall bill pro-rata. A list or separate attachment indicating the important data is required for this "no data / no charge" offer. If no list is provided, Ready For Knowledge, Inc. hourly rate shall apply in full regardless of what is recovered. Ready For Knowledge, Inc. agrees to use all resources and technology available (located at the data recovery laboratory in Carbondale, Illinois) to attempt said recovery, and CLIENT agrees that Ready For Knowledge, Inc. is in no way liable in the event Ready For Knowledge, Inc. is unsuccessful in recovering CLIENT'S data on the aforementioned medium. Any claims of missing, corrupted, or otherwise damaged data must be made in writing within 3 business days of your receipt of the recovered data. Ready For Knowledge, Inc. assumes no liability for damage to CLIENT's property during shipment or for uninsured shipments.

SERVICES ESTIMATE. Ready For Knowledge, Inc. hourly rate is $150 per hour for standard service and $200 per hour for priority service, plus the non-refundable priority placement fee of $300.  All amounts are payable in US currency only. Services estimate does not include evaluation fees (if any) previously agreed to by CLIENT for priority evaluation of CLIENT's medium. Ready For Knowledge, Inc. agrees to notify CLIENT in the event the cost exceeds this estimate by more than ten percent (10%).  Credit card charge-backs which result in the collection of funds from CLIENT by Ready For Knowledge, Inc. in a United States Court are subject to a 10% service charge.

PREPAYMENT AND FINAL PAYMENT. CLIENT agrees to pay Ready For Knowledge, Inc. for all services provided to CLIENT as described above. Any advance payment is to be applied to CLIENT'S final bill which is due upon receipt of an invoice from Ready For Knowledge, Inc.. Payment includes all applicable taxes (unless you provide proof of your tax-exempt status) including, but not limited to, sales and use, rental, excise, gross receipts and occupational or privilege taxes.

ENTIRE AGREEMENT AND ENFORCEMENT. This Agreement (including any Addenda) constitutes the entire agreement as to its subject matter and supersedes all prior and contemporaneous oral and written agreements. All changes to this Agreement must be made in writing and signed by both parties and, accordingly, any terms on your ordering documents shall be of no force or effect. Any action by either party to enforce this agreement shall be brought about only in the courts of Fairfax County, Virginia. Should any clause, provision, or sentence of this agreement be determined by a court to be invalid, that clause, provision, or sentence alone shall be invalid, and the remaining parts of this agreement shall be considered in full force and effect. In any action to enforce this Agreement, the prevailing party shall be entitled to recover its costs and expenses, including reasonable attorney's fees.
